Etihad Airways considers Premier League legal action after City decision

by Alex Matthews

Manchester City sponsor Etihad Airways is considering legal action against the Premier League following the independent commission’s financial-rule decision. The airline says the League did not give it a chance to provide information. It is therefore seeking legal counsel.

Sky Sports reported the development at 20:59 UK on 30 September and published the airline’s statement in full. Sky describes Etihad Airways as considering legal action. However, the statement itself says the airline will seek legal counsel on its options. It does not announce a court claim.

Etihad Airways rejects implications about its arrangements

The airline said it “categorically rejects any finding, conclusion or implication” suggesting involvement in improper commercial arrangements. It also said the redacted published findings did not name it. However, it argued that the public communication of the decision had created damaging implications for the airline.

These are the airline’s claims about the decision and its communication, rather than a fresh finding by a court or the independent commission. Etihad Airways disputes the implications it draws from the public statements. That objection does not itself change the commission’s decision.

Etihad Airways says the League did not seek its information

In the statement Sky reproduced, the airline said the Premier League had not reached out to or engaged with it during the process. As a result, it said it had no opportunity to provide relevant information or secure representation. It also said it had no chance to address the accuracy and fairness of information that might reflect adversely on it.

Etihad Airways said its commitment to Manchester City and their partnership remained strong. Meanwhile, it said it would seek legal counsel on “the options and recourse available to protect its interests”. Sky said it had contacted the Premier League for comment.

Etihad Airways legal advice is not a filed court claim

The distinction matters because the reported announcement concerns possible legal action and advice. It gives no confirmed court filing, claim timetable or legal outcome. Similarly, the Etihad Airways statement does not establish that Manchester City has filed its own appeal.

The Premier League’s published statement says an independent commission found City guilty of serious financial-rule breaches over the 2009/10 to 2017/18 seasons. It also found the majority of the non-co-operation charges proved. However, City disputes the findings and says it intends to challenge them.

The League says the commission will consider sanctions separately at a further hearing. In addition, its statement gives City until 2 October to exercise its appeal right. Although Etihad Airways refers to a Premier League commission, the panel that made the decision is independent of the League.

How the airline response fits the wider process

The League’s statement separates the findings from the next stage. It explains that the sanction hearing will remain private and confidential until the rules permit publication of its outcome. Therefore, the published decision does not tell readers which penalty the commission will impose.

The League also explains that the independent Judicial Panel’s chair appoints commission members. An Appeal Board, rather than the airline, hears a party’s appeal against a commission decision. Consequently, the Etihad Airways statement should not substitute for an official update on that process. Seeking advice, lodging an appeal and announcing a sanction are different steps, and each needs its own evidence.

What remains unresolved

The airline’s possible legal action and Manchester City’s appeal rights are separate developments. A statement that advice will be sought does not establish that either process has begun.
